Validity of the CGC
These General Terms and Conditions apply to sales contracts with private customers concluded via the website www.needesign.ch .
1. Characteristics of the products offered
The main characteristics of the Products are indicated in the specific Product sheet on the web page.The Products offered for sale may not correspond exactly to the real in terms of image and colors.The difference may be due to the browser or monitor type used. The images must be intended for illustrative purposes only.
2. Website and customer registration
The customer has the right to register on www.needesign.ch or to place an order without registration.In any case, the customer is required to provide truthful information about himself.needesign reserves the right to delete customer data at any time without reason or to block a username and password.
3.Availability and delivery times
neeDesign pays particular attention and commitment in publishing information on availability and delivery times and undertakes to indicate them in the online shop in the most accurate and updated way in the DELIVERY AND SHIPPING TIMES section.However, due to problems related to production and shipping of the same, there may be delays in delivery by neeDesign. All information on the availability and delivery times indicated in the offer or in the confirmation of receipt of the order are only indicative and are not binding.
In particular, needesign cannot be held responsible for violation of this contract in the event of delays in delivery or unavailability of the product due to force majeure, failures, interruptions or total/partial strike of postal services and transport, disasters and other natural events, epidemics.
4.Order and confirmation of sale
The correct receipt of the order is confirmed by neeDesign by e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will contain the content, date and time of receipt of the order and a"Customer Order Number", to be used in any further communication with neeDesign. The message reproduces all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections to neeDesign by e-mail.
The time of acceptance of the order by neeDesing is 6 days from the date of authorization in case of payment by credit card and of receipt in case of payment by other methods,
The customer has the right to cancel the order within 3 days from the date of purchase.
In case of non-acceptance of the order, neeDesign undertakes to promptly communicate to the customer.
In case of payment by credit card, the authorized amount will be blocked on the customer's account and actually debited at the moment of acceptance.
In case of payment with other methods neeDesign reserves the right to cancel the order for non-credit within 6 days from the date of purchase; any refunds due to the cancellation of the order will be made within the following 15 days.
Once the payment has been debited, it will no longer be possible to cancel the order. In case of problems, do not hesitate to contact us and we will try to find a satisfactory solution for all parties.
In the event neeDesign is unable to guarantee acceptance of the order on schedule, the communication will be provided to the customer by e-mail and/or information on the website www.needesign.ch
5. Prices
The prices shown on the website are expressed in Swiss francs (CHF). Shipping costs will be charged separately.
Shipping costs are indicated in the"checkout"phase. For some products it is possible to request the assembly service. The customer must express this requirement in the additional information for the seller. These costs must be agreed, budgeted and paid separately.
neeDesign reserves the right to change prices at any time.
6.Pagamento
The purchase with debit or credit cards is charged at the time of the order.
The payment data by debit or credit card are transmitted in encrypted form.The order process will be done in a safe area in the presence of the 3-D Secure security code.
Prices are displayed on the website in CHF and you can only pay in CHF when paying.
The payment methods allowed are:Mastercard, VISA, PostFinance Card credit cards. Transaction costs are at our expense, therefore no other fees are added.

7. Shipping and delivery costs
Shipping costs are charged to the customer and are always indicated in the order summary, during the checkout process and calculated separately from the product price, before the payment confirmation. Shipping costs include transport insurance and any customs VAT and duties. If you purchase multiple products from different suppliers, separate shipments will be made and delivery times will be different, delivery costs will be the sum of the individual shipments.

The customer has the opportunity to choose different shipping methods:
Large volumes:
Product shipped with dedicated forwarder:
Transport INSIDE DELIVERY:delivery to the floor with unpacking, installation of the product and collection of the material used for packaging, assembly works are excluded.
STANDARD transport:delivery of the parcel on the street level, unpacking by the customer.
Delivery is carried out by specialized personnel and on suitable vehicles. The customer will be contacted directly by the shipper to schedule delivery by appointment (date and time). All goods travel with insurance coverage. The customer is obliged to communicate promptly to neeDesign and/or to the shipper any complications related to the place of destination of the goods:impracticable, inaccessible roads, or provided with transit permits and situations of difficulty in reaching the floor due to the absence of a lift or stairs with restricted spaces.
Small volumes:
EXPRESS transport:delivery of the parcel to the street level.
Through the email address or alternatively the telephone number that the customer has provided, the shipping system transmits an Alert informing the customer of the delivery, the recipient can independently indicate the delivery time or postpone the date, if of absence, a double pass is made with a second Alert, without additional costs. Subsequent deliveries will cause additional costs that will be charged to the customer.

In the event of damage or breakage of the product, the customer must promptly announce it to Swiss Post which will draw up a report and verify the compensation.

needesign delivers to customers in Switzerland. Any shipments outside Switzerland will be checked from time to time according to the item sold and according to the place of destination.If not otherwise agreed before the purchase, any additional costs due to transport , the customs or foreign VAT will be charged directly to the customer.
The working days mentioned in these GTC are meant every day except Saturdays, Sundays and public holidays recognized legally on the Italian Swiss territory and in the Canton of Ticino, by the courier in charge, the post office, the shipping and/or transport company and at the customer's place of residence or residence.
If the INSIDE DELIVERY and STANDARD delivery service cannot be performed for reasons charged to the customer (for example due to the lack of presence on the agreed delivery date), the package will be retained in the shipper's warehouse for a maximum of 30 days, subsequent delays will cause additional costs that will be charged to the customer.
8. Additional services:assembly and disposal
Transport with assembly:WHITE GLOVES
Assembly includes delivery, unpacking, assembly of the ordered products and collection of the packaging material.
Disposal includes the collection and environmentally sustainable disposal of the objects indicated by the customer at the time of purchase. These must correspond in form and quantity to the product ordered. The objects to be disposed of are supplied by the customer ready for transport, respecting the delivery terms of the ordered products.
If the assembly service cannot be performed for reasons to be borne by the customer (for example due to failure to respect the date, incorrect dimensional information etc.), the additional costs for such delays will be borne by the customer.
9. Receipt of goods and verification requirement
Large-volume goods that are delivered through shippers are usually notified in advance by telephone by the shipper.If the customer is not reachable by phone, he will be contacted by e-mail and urged to contact the shipper.The delivery address must be accessible via the Swiss road network.If the delivery location is not accessible or is only partially accessible with a normal truck (especially in mountain regions and locations closed to traffic), delivery will only be made to the next accessible location accessible without further difficulties or additional costs.The customer undertakes to take the necessary measures to accept the delivery of the goods.The additional costs caused by the lack of these precautions will be borne by the customer.
In the delivery of the products, any damage to the packaging and/or the product or the mismatch in the number of packages or indications must be immediately contested , by placing the word"ACCEPTED WITH RESERVE"on the delivery receipt of the courier, specifying the reason for this reserve (for example:damaged package, missing package, part or all of the damaged product etc ...). Once the courier's document has been signed, the Customer will not be able to make any objection regarding the external characteristics or content of what is delivered. problems concerning the integrity, correspondence or completeness of the products received must be reported promptly within 1 day of delivery, by email communication to be sent to neeDesign customer service:info@needesign.ch with attached photos and documentation attesting to this damage .
10. Option to return the goods, withdrawal
neeDesign does not accept product returns as they are personalized according to the indications requested by the Customer and for which they have been made:finish, colors, dimensions and additional processes, unless they are delivered non-compliant or defective.
However, it is possible to return only the selected products called RETURN LINE within 7 calendar days from the date of delivery of the products.
To exercise this right, the Customer, within 7 working days from the date of receipt of the goods, must send a communication via e-mail to neeDesign , stating that he wants to exercise the right of withdrawal and indicating the order number, the invoice number, code and quantity of the items, if the withdrawal is partial (only if multiple items are purchased) or totally.
neeDesign, after checking the integrity of the goods, will proceed within 15 days from the return of the product, to send the customer a voucher of equal value, retaining only the amount of shipping costs and any additional services.
The voucher will be usable on the site within one year from the date of issue and can be used on all neeDesign products excluding promotional items.

The Customer must always contact neeDesign via e-mail to obtain the return number of the goods.The goods must be returned intact in the original packaging properly sealed, complete in all its parts (including packaging, internal protections, documentation, accessory equipment, equipment assembly etc.) to neeDesign by courier commissioned by the customer.
The shipping costs for returning the goods are charged to the customer.
The right of withdrawal is however subject to the following conditions:
To complete the return, an invoice or proof of purchase is required.
The law applies to the product in its entirety, it is not possible to exercise the withdrawal only on a part of the product.
Customer shipping information:
The shipment for the return of the material, up to the certificate of receipt at the needesign site, is under the complete responsibility of the Customer.In the event of damage to the goods during the return transport, neeDesign will notify the Customer of the event (within 5 working days from the receipt of the asset at its headquarters) to allow the Customer to promptly file a complaint against the courier chosen by him and obtain a refund of the value of the asset (if insured); in this case, the product will be made available to the customer for its return and at the same time will cancel the request for withdrawal and therefore a refund.
neeDesgin is not liable in any way for damage or theft/loss of goods returned with uninsured shipments by the Customer. Upon arrival at the headquarters, the product will be examined to assess any damage deriving from transport. If the original packaging and/or packaging is excessively ruined, neeDesign will withhold from the refund due the costs incurred for the restoration of the same.
The right of withdrawal is lost for lack of an essential condition of integrity of the good, in cases where neeDesgin ascertains:non diligent use of the good that has compromised its integrity or the use of any consumable materials; the lack of the original external and/or internal packaging; the absence of integral elements of the product (screws, etc);
In the event of forfeiture of the right of withdrawal, the goods will remain at the needesign premises available to the customer, for collection at his own expense.
11.Gift vouchers
A gift neeDesign is a special type of product. Its value can be used as a payment for future orders at neeDesign. It can be sold like any other product or it can be issued as a form of prize, incentive or refund. When a voucher is issued gift, the customer receives an email containing a unique code that he can use at check-out to redeem his value.
During the purchase phase, the customer can redeem the value of a gift voucher by entering the unique code at the time of check-out. This code does not take into account the difference between upper and lower case. Gift certificates have a balance that can be spent for more than one order. Gift voucher balances apply to the total value of an order, which includes taxes and shipping.
When a customer redeems a gift certificate, checkout shows one of the following options:
If the balance available on the gift voucher is greater than or equal to the total of the order, the customer can click on Complete order.
If the balance available on the gift voucher is less than the total of the order, before submitting the order, the customer is asked to choose a second payment method for the difference.
Customers cannot check the remaining balance of a gift neeDesign , but they can contact neeDesign to receive this information
Most discount codes cannot be applied to gift vouchers. The only exception is when it is a specific discount code for a product, where the product is a gift voucher.
Gift vouchers can be used in conjunction with a discount code.
Gift voucher codes are considered as currency, therefore only the customer can view the entire code.
The voucher is not nominal, it can therefore be transferred to third parties, vice versa the loss, loss or theft of the aforementioned cannot be refunded in any way.
The voucher cannot be used beyond the expiry of its validity, however the customer has the right to contact neeDesign to negotiate its extension.
neeDesign is in no way obliged to guarantee this extension.
12. Warranty and defects, replacement or refund
If a product is defective or does not conform to what was purchased, the buyer can assert his warranty right for two years.
The customer is entitled to one of the statutory warranty claims (refund, price reduction, replacement delivery)
Damages due to wear and tear from use are not included. Faults caused by improper use, lack of maintenance or tampering by third parties void the warranty.
Products considered non-compliant, non-functional or defective can only be replaced following an examination by the Supplier. Defects and non-conformities must be proven by sending photographs via e-mail to neeDesign and to the manufacturer.
If the photographs are not sufficient, the contested products must be sent back to the Supplier.
Once we have received and inspected the return, we will send you an email to inform you that we have received the returned item.We will also inform you of the approval or refusal of the replacement or refund.
If approved, the refund will be processed and a credit will be automatically applied to the credit card or original payment method used, within 15 working days of confirmation of the refund.
If you have not received a refund, you need to check your bank account again and contact the credit card company, as additional time may be required before the refund is officially registered.If you have not received your refund yet after this procedure , please contact us:info@needesign.ch.
13.Declaration on privacy
The privacy policy is an integral part of these terms and conditions. By accepting the terms and conditions, the customer also accepts the privacy policy at the same time. Here is the link to our privacy policy.
14. Use of purchased goods
The use of the website and the online store is only allowed for private use.Any commercial use, such as resale to third parties, of the products purchased in the online store is prohibited.
15. Applicable law and jurisdiction
These GTC are governed by Swiss law.
